This prerequisite does not have an exception for being married to the person you want to marry. However, as was mentioned by another person previously, all states will recognize a marriage in another state. The only exception to this is MA and gay marriage. Most states have said that they will not recognize a gay marriage (which some believe is unconstitutional).

  • 12-18-2016 What do you think "marry" means? The entire nation seems to have forgotten the meaning. You probably assume that marriage is a legal privilege granted by the state government, but there is a little more to it than that. Marriage is a natural condition. A man and woman are married if they DECIDE they are married. A record written in a family bible is acceptable evidence of marriage in any court in the country. Two witnesses who will testify that you presented yourselves in public as husband and wife will do. It was after the civil war that the marriage license was invented, specifically so it could be refused to mixed couples. That only meant black and white, since nobody cared about any other mixture. The legal basis is that a marriage is a three way corporation for the purpose of making babies. That is how the state claims jurisdiction over the children, setting aside parental authority. After all, the state is one third owner of the corporation that manufactured them.
