  • There are several definitions to the term "adultery" so first you need to say which you mean; however I am sure you are meaning "sexual adultery". Biblical sexual adultery could ONLY be committed by the woman and ONLY if she were married. The man, not her husband, was charged with theft of anothers property as wives were considered the "property" of the husband. The wife could be put to death. Today it includes both the man and the woman and though not necessarily illegal is grounds for divorce in many areas. Adultery in itself I do not believe it should be illegal. In olden days it was important to the master to know that any children, especially male children, were his ligitamate aiers to his property. We no longer have those requirements. So adultery only needs to be worked out by those involved and not involving law.
  • I agree. Sex is supposed to be inside marriage. This will reduce so many problems that caused by adultery such as unwanted pregnancy, troubled marriages, parent-less kids and so many other problems.
  • It actually still is in some states. And I wouldn't mind it being illegal if that is what the majority of the married people wanted it. But man doesn't have a good record in enforcing laws where the heart is involved. What would constitute adultery? To some it might be just kissing, other might have it as intercourse or other types of sex. Who would enforce it? How would you verify it? I see it making everyone telling on others, one word against the other. It just can't work unless people wanted to live by such a law and since people don't it wouldn't work and would be a useless law.

  • It has been in the past, and that didn't stop it. What punishment would you impose? Fines, to impoverish the household of both adulterer and wronged spouse? Or imprisonment, to make certain that the wronged spouse loses their partner whether they want to or not? How will the law stepping heavy footedly, expensively, clumsily and slooowly into people's relationships help them? Do you really feel that you want to explain your spouse's behaviour to a policeman on the desk when s/he is hauled in under arrest?

  • Not at all. Not only is it not anyone else's business but I would not want to stand up in court and tell everyone my husband cheated, thats too personal. It is bad enough the divorce would be a problem for any children involved with out daddies cheating being spread around the neighbourhood. In New Zealand there is only one reason for a divorce, other than obvious abuse, and that is irreconcilable differences. This is so that neither party has any legal blame attached to them. As to any personal blame, that is between the two parties involved and no one else.

  • Yes. It used to be, and because of that, a cheated-on spouse had a better chance of suing the "other" for damages, so at least there was significant possibility of some sort of punishment.
  • It's actually on the books in many southern states as illegal. The laws are not honored as far as arrests and jail time, but the law sure is honored in divorce court (as most states).
  • Personally I think it should be. It may be hard to prove & then find a place to put half the population that commit adultery. Maybe if it were people would think more before doing it.   • adultery (this should include women cheating as well) should probably be illegal, actually. it is not legislating morality whatsoever. it is legislating a contract. marriage is a contract. it has complex and varied contractual and legal benefits as well as different rights and responsibilities (guardianship, property, labor, incarceration, taxes, etc) which changes social and legal status, and is recognized by the state. whether it should be prosecuted civil or criminal is another story.

  • It is grounds for an Alienation of Affection lawsuit in my state, and the wife of a very prominent congressman in my state made front page and local TV news two days ago when she filed an Alienation of Afffection lawsuit against her ex-husband's s***. All comments and blogs are 98% in favor of what she is doing;maybe it will make these weak-willed, pathetic excuses of men think twice before they decide to play with a ho-mate while they are married.
