Do you believe in Innocent till proven guilty or Guilty till proven innocent?

    It is stated innocent until proven guilty in a court of law but this really depends on how you look at it. When a crime is done and you become a suspect you are treated as if your guilty this is why when questioned you have to provide an alibi this is why you are asked for DNA and finger prints to prove your own innocence. When your questioned they talk to you like you did whichever crime as if your guilty. when you go to trial you become the defendant and must prove your innocence or they will prove your guilty. It becomes your and your lawyers job to prove your innocence. So your never innocent until you have been found innocent in a court of law. at least thats how I see it.

    I'll go with innocent until proven guilty. The costs to individuals, families, and society as a whole are far too great to assume people are guilty until someone proves them innocent. Things are bad enough now because innocent until proven guilty isn't always the way things actually work, but to make its reverse the standard - that's a frightening thought indeed.

    Innocent until proven guilty. Always. It's how I want to be seen if I'm ever accused of a crime, and it's the very cornerstone of the legal process. "Guilty" means your accusers proved it, beyond a shadow of a doubt.

    I got a DWI years ago and had to go to county jail for a day. It was awful. The sheriff deputies that work there treat you like you are definitely guilty.

    i try my best to see everyone as innocent unless they give me a reason to see them guilty. however with the way the court system is nowadays and the media whatnot...you always did it even if you didn't...

    In the US, the concept of "guilty" is a legal definition, and can only be decided in a court of law. It has nothing to do with whether the person actually committed the crime or not, he cannot be legally guilty without a trial.

    let me put it this way in kentucky your guilty until proven innocent... fucked up yes, but look at from the eyes of someone that is being blamed for a crime they didnt even commite. say your a guy that meets this girl, she says she is going to be 18 in a few months, she looks it, and she is in high school, you assume that she is telling the truthe, you dont want to start asking for her drivers liscense and birth certificate because you dont want her to think you going to be some freak that is going to steel he idinity. so you start talking and getting to know each other when you simply ask her if she is will to drive out to your place and see you. when she replies that she doesnt have a drivers liscence becuase she doesnt have a job, nor a car. you go with it thinking that possibly you can truely trust this person is telling you the truthe, meanwhile she is really telling you a lie the whole time. she is really underage and just acts as if she is older because she likes you and dont want you to be turned away from her because of the real age. then one day you get contacted by an older sibling telling you that she is really underage and that they will kill you if you dont leave her alone. you then break up with her and tell her friends is all we can be... you run into her in town every once in a while and you still talk online and on the phone as friends do, then one day you get a call extremely early in the morning when noone in there right mind would really be up asking for a ride to school because she has missed the bus, dazed and confused of whats really going on you agree just to find out they it was all a plan to get you to come over so that she could have the cops called on you and her family accuse you of having sex with her. you are threatend by family members and told if you stay away from her and have no contact with her they will not press charges. mean while you think if i can go somewhere else to get away from these people and have no way of contact you will be safe when a day later you get a phone call from number you dont know, you dont answer it, you then get another call the next day saying that you have to come back to your small town for questioning. so you drive back thinking that it cant do any harm to tell the truthe, but when you get back the police start accusing you of things you know you havent really done. you are accuse of having sex with the girl when you have never had sex with her, you have only seen her in person about 10 times, you keep telling the police that you are innocent but the already have a warrent for you arrest you are not " guilty until proven innocent" they slap handcuffs on you and take you to jail to wait to find out what your bail bond is. you spend the night thinking oh i'll be out of here in the morning just to find out you have to wait 5 more days to go to court, once at court you find out you have bail bond that is over 50,000+ dollars, you think shit i cant pay that you then wait for another week just to go back to court to find out they are going to 10% it so you can be bailed out.. but theirs a catch you have to spend the next 3 to 6 months on house arrest. you are not aloud to leave your proporty, you have sold your only means of transportation to bail money, you cant get a job and no woman wants you becuase you are being accused of a sex crime. you are innocent but being that they law thinks other wise you must now live with your parents. you know nothing other than what you are being charged with and their is a possibility that you may find enough proof to get the court to drop the case and you get nothing out of it, or you get charged with a mistermeaner and have to spend god only knows how many months or years on probation in the same town and state that you are being accused of in the first place, or the really shitty think you get to spend the rest of your life in prison over something you didnt do in the first place. you hope and pray for the best but you know in your heart that even for your first time in trouble with the law your are going to spend the rest of you simple life in prison for a crime you never commited in the first place. so innocent till proven guilty? or guilty till proven innocent you decide because the justice system sure as hell cant!

    It don't mater what any of us think here. The whole world See's the accused as "GUILTY TILL PROVEN INNOCENT". Even people who have never met the accused, think it with out knowing it. For example; Say suspect get's arrested for something, anything. They put him in handcuffs, in front of family, co-workers, friends and strangers. Already in the minds of the spectators, that the person (The Accused) who was arrested is guilty.

    Let me repeat a quote from our local district court judge; "Get the idea of fairness out of your heads, because there is nothing fair here" - Allen co Ky District Court Judge 2008. I'm sad to say it but if you go to court anywhere in the world, YOU BETTER BE ABLE TO PROVE YOUR INNOCENTS, for they will prove you guilty if you can't.

    I would love to say that its innocent till proven guilty. This is what we have been told our whole lives, and along with that comes a fair and "speedy" trial. Not many people know that even in trials that take 2 and 3+ yrs they are still considered "speedy" by the courts definition. With that said it leads to why I have to say guilty till proven innocent, and alot of times it even seems that its more "guilty but your lawyer found a way to trick the judge/jury to let you go free.

    A person in this country can be accused of a crime be arrested and be put in jail for the duration of the trial (sometimes 2-3 yrs). Now it may be me but being in jail for a couple yrs sounds like your guilty of something to me. You may say that well if you are found not guilty (lets be strait your never found innocent) then your free to live on, but what happened to your life in that time in jail? I know that even after a month or so I'd lose my job, home, car, and everything else I make monthly payments for. Guilty or not this puts alot of strain on a marriage and causes alot of them to fail so now you lose your spouse and kids. so when you finally get out "free" you have no home to go to no wife/husband to welcome you, no job to return to, and no kids to hug you. When you go out and try to gain new employment you have to explain the gap in your employment as being in jail, just the word jail is where alot of people stop listening they dont hear found not guilty.

    One persons wrong move doesnt always stop when he finishes his crime, sometimes our justice system keeps making more victims.

    So I have to go with "guilty till your lawyer tricks the judge"

    GUILTY TILL PROVEN INNOCENT SO IF YOU ARE IN OUR AREA THEN WATCH YOURSELF IF YOU HAVE TO REPORT TO THE OFFICERS AFTER YOU ARE OWN PROBATION THEN YOU ARE ARRESTED AGAIN

    In 2007 I had a legal challenge with a housemate. I was falsely accused of trying to kill her amongst other absurd charges and I unknowingly violated a temp. no contact order by shopping at my local Safeway. I was stopped, questioned and released, I was to appear at a hearing the following morning. While waiting for my hearing 10 minutes before, I was arrested in the courthouse and taken to jail. She called them saying I called her with more threats. I was jailed for 13 days, and if my relatives did not get an attorney, I would have faced a year in jail with a felony. I was PR'd after the judge read my emails to my housemate and bail was dropped. The case was then dismissed both civil and criminal no contacts recalled or not granted. But someone did not want me to say I had something else going on. She stole about $500 worth of property from me as she moved out amongst other things and her actions was just a smokescreen. From my point of view, it is guilty until proven innocent.
