The Devil doesn't have the power to punish or judge. He is a created being. Only God does. The Devil is called "satana" in Greek, which means "accuser". The devil accuses people, having led them into sin in the first place. In effect, he is laughing at them for having fallen for his lies.

The job of the Devil is to take the fall for the bad things that happen to humans. This frees humans to believe that God is entirely good. In Judaism, there is no devil. Satan works for Yahweh, and His job is to tempt humans (as seen in Job). In Christian theology, the devil has no real job. He simply is in a power struggle with Yahweh. Christian theology holds that Yahweh is the punisher, and the Devil will be one of the punished.

Biblically speaking, God punishes miscreants all the time, so I would assume that it's his department as well.
