My neighbors tree had a large limb break during the recent storms-it did not fall because it is caught on another limb-however it ishanging over our privacy fance and driveway where our car is parked if it falls who is liable?

You can cut down anything that is hanging over on your property. Start cutting. It is their tree, but they'll say it was hanging over, and they left it there so we don't have to pay.

Ask them to have it removed. If they refuse you can certainly cut it down on your own since it is technically in YOUR yard.

Nobody. In order to be held liable, you must do something wrong. Your neighbor did nothing to cause this situation, and you are aware of the problem and still parking your car under the limb. Thus, your neighbor is not liable because he did nothing wrong. You are not liable because you have no duty to fix your truck.

Fire up your chian saw or go rent one and a ladder. Cut it off a small piece do not try a big piece. Put it by the curb if you do not have a fireplace. Cheers
