What if we signed a month to month lease and it has someone elses name at the top or on the sheet is it a binding contract

    Yes, it is legal. Witnessess can prove you lived there. They can do a handwriting anaylis to prove it was you.

    Very few landlords require a formal lease agreement for month-to-month rentals. Under the circumstances, I presume that it would be a binding contract is you actually SIGNED it.

    The name could be explained as a typographic error in a court of law. The signature is key.
