  • If you really are in a bankruptcy, you should already know this answer. If your vehicle was not included in the backruptcy, thats your fault. you should have included it from day one.

To answer your question, typically after 2 months of non payment in Washington state at least, they will begin the necessary legal steps to repossess the vehicle. Also, what happens is that after they repo the car, they sell it at usually a much lower price, and then sue you for the remaining amount. IE- if they sell your $50,000 car for $20,000, you're left with $30,000 that you're going to be sued for. Since you can't add it to your bankruptcy and you can't make the payments, your only options are to find someone to assume the loan or get it repo'd. Another quick note, remember they can't get blood from a turnip! Anyway, good luck, and I apologize for others leaving nasty answers that don't address the question in any way.   • Boy, there is a lot of misinformation on this website. Disabled citizens have differnet rules regarding bankruptcy and disability. And each state has different bankruptcy guidelines. For example, if you are disabled, then you can own a vehicle worth up to a certain amount in your state. And what type of disability can make a difference. Did you retire with private disability or did you get social security disability benefits? Social security disability cannot be garnished. All of this should have been explained to you by your bankruptcy attorney. I hope that since you asked this question that your life is on an easier track. For anyone else filing bankruptcy who is on disability, make sure you know the different rules that apply in your state bankruptcy court. The rules are on the net and can be found by doing a google search.
