If there is no evidence the prosecution would look pretty stupid when the case came to court. In addition they would leave themselves open to charges of false imprisonment and malicious prosecution.

Nope, you can't get an indictment without sufficient evidence to support the case.

You can get charged AND convicted!

It would not even get to court,and if it got that far the judge would though it out of court and reprimand the prosecution.
