A parcel of land was intended to be for public use within an HOA development. It instead became a privately owned parcel through developer collapse. The parcel is vacant and is still zoned "public use area." Can the HOA collect fees from the new owner?

Your documents should clearly answer this question. Look under the "Assessments" section. It mgith state something like..."Each owner of a lot will pay..." If your community has a general attorney check with them.

Insufficient information. Without knowledge of the transactions, it is difficult to ascertain whether your HOA has the ability to exercise any control over the new owner. This may be one best settled in court.
