That depends upon several factors. Do you truly own a townhome and not a condominium that only LOOKS as though it is a townhome? Check that out first, then go to County and State laws. In most cases, however, the HOA is indeed responsible for flooding damage and sewage backups. Their Master insurance policy would detail the exact civerage. Your HO-5 simply covers contents that may (or may not) have been damaged by the flooding. Uf the HOA is dodging your calls, that may indicate that they have already reached their coverage limit (per occurance). This may leave you no choice than to litigate ... and I *NEVER* make that recommendation.
