It's not because he's older than you, it's because he's older than 18 and you aren't. Charges would have to be pressed but yes, I know a guy that spent 3 years in prison for this very thing and is on the data base where you look up sex offenders in your area, which is awful!!!!!

Have you had sex with him? If so it depends on your state law. Some states they couldnt because the age of consent is 16 but other states it is 17 or 18. In two states, South Carolina and Arkansas it is 14 for females. So what state are you in and I can answer?

You're parents cannot charge him unless they are part of the legal process. They can request he be charged, but the charge will only go as far as the laws in your area allow it, and if there is any evidence of sexual contact.

Depends on what the consentual age is in your country. The consentual age is when you can legally have sex. He can only be charged for having sex with a minor if he is over the age of majority - age 18 in most countries - and his partner was under the consentual age. I am not sure about your particular state, in N.C. at 21 years of age a male/female is considered an adult by the state. Because you are 16 years old, you are considered a minor by the state. The charge of statutory rape can be used when an adult (someone 21 or older) has sex with a minor (someone under the age of 21). Your parents are more than likely telling you the truth.

well, i have to be the first to say that you shouldnt be with someone that much older than you.. it isnt the age difference, its that ur only 16,but i'm not ur mom, and its ur decision... but the laws are different in every state. some states say that 16 is the consent age for sexual intercourse... which would give you the right to make that decision for yourslef. but, it doesnt mean that he cant be charged with rape... fact is he is a grown man.. what buisiness does he have messing around with a 16 yr. old n e way??? i knw u dont want to hear it, but someone needs to say it! he is too old for you, and you are too young for him.. period. why not try being a teenager and start looking at ppl closer to ur own age? it is rape... he is an adult and you are a child... end of story! you arent emotionally mature enough to make those kind of decisions... and he should know better!!!

my little sister was younger with older. she also didn't have a BF, she had a freakin harem. they couldn't press charges because she wouldn't cooperate. your BF is taking a trusting you big time if your state does not consider you age of consent. efen if I was in a relationship with an "underage" I could not trust a female not to change her mind and get me charged.
