An animals brain is smaller than a humans but all of it is used. What gives us the right to say we are more intelligent than animals when we only use a small part of our brains?

It's a myth that "we only use 10% of our brain". We use it all -- the saying is just a metaphor for the untapped intellectual potential within all of us. Incidentally, many animals have bigger brains (elephants, whales, etc). What distinguishes us is our enormously convoluted cerebral cortex, where high-level processing occurs.
