In Pennsylvania and I'm sure in a WHOLE LOT of other states it IS DEFINITELY rape.

I don't know about the american laws but here in France we have a difference between legal majority and sexual majority. The right to vote and legal reponsibility is obtained when you're 18 and sexual majority (the right to consent to have sex with someone else, however old he or she may be) is obtained at the age of 16.

So even in our very open system, your relation would be rape. If caught by the Police or any other judicial body, he would be brought to court. And they wouldn't take in account the fact that you agreed to have sex with him because the law says that a 13 year old isn't capable of such decisions.

Also, you should know that a 21 year old dating a 13 year old MUST have issues. The difference in maturity, both mental and physical, is excessive with such a difference in age.

Now I'm not saying having sex at 13 is a problem. It is definitely not a problem by my standards if you do it with someone that's also your age or one year older, tops. I had my first sexual relation myself at the age of 14 and I can't say I'm not a normal guy.

Just remember to always, always, ALWAYS use protection.

And finally, I recommend that you speak about this to an adult you trust, that's exterior to your close family, like a school counselor or doctor. He might be able to give you some advice on what to do and how to do it.

And you also may want to ask yourself what someone so "Old" wants with someone so "young". Is he mature himself? Is he not afriad of the consequences? Is it a real relationship (with substance)? Are you in a country that allows that? In most cases, its probably a bad idea if you have to ask.
