Can two married people, getting divorced, that own a two family house and decide to both reside in the home in separate apartments both take out separate home equity loans, if one persons name is on the mortgage but both are on the deed?

    I'm not sure, but this might be possible if you're both listed as tenants in common rather than a joint tenancy.

    Check with a lawyer.

    THERE MAY BE A FIRST AND SECOND MORTGAGE- IN EITHER NAME. BUT GENERALLY, IF BOTH NAMES ARE ON THE DEED, BOTH HAVE TO SIGN THE MORTGAGE, NOT THE LOAN DOCUMENTS. IF BOTH HAVE NOT SIGNED THE MORTGAGE- AGAIN, NOT LOAN DOCUMENTS- THEN NO.
