In the state of Texas is it legal to record a conversation with the intent to use it in a court of law without the prior consent of both parties?

    According to TX law, you can record a conversation on the phone or in public so long as one of the party's involved are heard on the tape as being present to reinforce the taped testimony, you only need to be present on the tape as you are the knowing person participating and consenting to the recording, no one else has to know you are recording. It may have to be written or typed verbatem as the court does not like to listen to inaudible tapes that are not clear, so if you wish to submit such evidence have a transcript of what is stated on the tape.

    To my understanding, you cannot record a conversation with anyone unless you tell them before the conversation starts that they are being recorded.

    No. The state of Texas is a one party state. This means that so long as one person in the converstation knows that they are being recorded it is legal and admissible.
