The police do not "charge" people with crimes. They make arrests and then submit the case to the local prosecuting agency (District Attorney, city attorney, etc.) That agency makes the decision whether or not to file charges. Even if charges are not filed by the time of the court date, the prosecutor will still have additional time to file charges (within the statute of limitations). How long that is depends on whether it's a felony or misdemeanor and your jurisdiction.
