You're reading I recently purchased a house in NC. The seller disclosed there are no restrictive covenants on the property. After moving in, we found out there are indeed restrictive covenants that affect how I wanted to use the property, what is my legal recourse?
Comments
Yes, I have it in writing. It is stated on the sellers disclosure. yes we had a contract prepared by a licensed real estate agent. The house had been listed as FSBO, but he had paid to hace it listed on the MLS. I don't remmeber if the listing specifically had it. I'm bothered by this even more because I had title search done and had an attorney at closing and neither of these turned up the covenants. It appears they didn't really do their job, so I'm not sure what I paid for. Thanks for the advice, I will be speaking with a lawyer (a different one needless to say)

If the restrictive covenants did not show up in a title search and someone paid for a title insurance policy, you might have a case against the title insurance policy too. Something else to keep in mind.
