I am interested in starting a 401k or IRA. I currently reside in Texas and have a wage garnishment from California, for current and back child support. My question is, can 401k or IRA be garnished for the back child support, before I draw the money out?

    In Texas the goverment can take any account they find for back child support. Ask my ex. I had nothing to do with it and it was after our youngest child turned 18. they took every cent out of his account and left a negative balance of over 30K. Since I did not need nor want his money, I had to go through hoops to get it stopped and returned.

    Well it is obvious you want and answer to YOUR question since you asked the samething twice. I am in the mortgage industry and lost an 80k per year job back in 2006. I was out of work for a little over a year and drawing unemployment for 6 months of that time. I have landed a job in my line of work and, am now paying my back and current child support obligations. Know that people fall on hard times, it is how they recover that makes the man, not how he lies down. I have life insurance, pay my mortgage on time, have paid off credit card debt and, am living a very blessed life. I saw that you are in law enforcement and have been for the last 42 years. That explains the tone of superiority you feel you are entitled to. I am sure you probably think I am a dead beat bum, father who abandonded his children. That would be like me assuming you're a sister kissing, redneck, hillbilly sherriff that covered up the King assasination because you're from Tennessee. You could be I don't know.
