  • This will vary by state, but in most states, after you have fulfilled your due diligence requirement (i.e. done everything possible to find and serve your spouse), you can then serve by publication. Service by publication basically require you to put notice in the newspaper for several weeks. After you have put notice in the newspaper and waited the statutory period, you can then sue in your spouses absence. Again, the exact requirements will depend on your state, and some states may not even allow this.
