You'll have a better chance maintaining that claim if you register a complaint with the police stating that you are being threatened by this person.
If he shows up to beat hell out of you, and you, expecting it, pull out a knife and go to town, you could just as easily get in LOTS of trouble... and the word "premeditated" is never good to add to a charge.
Interesting choice to carry a knife. Hope you know that you will still have to physically over power him and then there is a good chance he can turn the knife on you. you know what might be better? ninja stars. so you can get away like the wind.....

In Britain it is an offence to carry any knife except a folding pocket knife such as a Swiss Army Knife. The only exceptions are knives carried for a professional or domestic reason such as knives carried by a chef on his way to work. Any knife, including a folding pocket knife can be designated as an offensive weapon if it is used to threaten or harm somebody else. If you are caught carrying a knife without a legitimate reason to do so you face a heavy fine of a gaol sentence.
Even if it is legal to do so, simply carrying a knife won't help. In the hands of somebody who doesn't know how to use it a knife is dangerous to the person holding it, especially if he uses it threaten somebody with experience of street-fighting, or even simply a predilection for violence.
So whether you live in Britain or elsewhere the best advice is to seek help from some legal agency. One last piece of advice: Remember that what you read on answerbag is not guaranteed to be correct.

I would report this to the police ASAP. You can tell them you are arming yourself with a knife but you should provide them with any evidence you can. Include the name, address, discription of the person also.
If you hurt this person, it still is one person's word against the other, but there is a record of your fears.
It will be extremely difficult to prove your case without police records backing you up. Between 2 people it is nearly always a he said/she said scenario. Do NOT do this without police intervention. You need to establish a history of threat with this person that the courts can recognize, especially if the other person wins the physical fight....which I hope never happens in the first place.
It depends on how you are attacked and how you defend. You cannot use lethal force to resist non-lethal force.
And using a knife is lethal force.
Depends on the specific circumstances. You need to be able to prove that he was a deadly threat and that you had no other reasonable option but to use your knife on him. It will help proving he was a problem if you try to get a protective order against him. He would have to attack or be preparing to attack you with means to cause death or serious injury. You have to have no other option, be unable to escape or depending on jurisdiction be at home, usually you don't have to flee your home before you can prove self defense. If you can get away without violence you legally must. If he comes with less than deadly force, you are only allowed to respond with "reasonable force" usually in kind: empty hands, pepper spray, sometimes tasers.
You also need "clean hands". I know of an instance where a small time dealer was ambushed at his home with his wife and child. He fired at their leader and missed, except for the drugs, this was a clear case of self defense, but he spent about 2 years in prison for this. The police will treat any killing or near killing as murder until they prove ir is not. If you are engaged in anything that could be seen as criminal when attacked, self defense automaticly becomes a felony.
Call ther police and tell them. freely walk with weapon then.
If he attacks you it is self-defense. You have the right to use reasonable force to defend yourself.
If you kill the guy, or even if its an attempted murder you will be tried by 12. Theres no say you will be let go under "self-defense".
But, check on your states make my day law..

Report it first because then there is a history of him making threats if it ever comes down to you having to hurt him you have a defense. If it ever does happen and you can defend yourself without the knife do it because pulling a knife escalates things and if you are not willing to use it than just leave it at home cuz if you pull and don't use he will most likely use it on you! Taking someone on with a knife is a huge thing it is VERY personal and a hard thing to live with(and yes I am speaking from experience)

You can only use an equal ammont of force to protect yourself reguarless of which state you live in, the first thing is to report to the police. You cannot use any type of weapon aginst a person who is unarmed unless they greatly out weigh you and you are in fear of your life, even then you have to retreat and attempt to get away from them befor you can use a weapon. Get a cane much better defense tool and less likely to end you up in jail.

For your protection i would first get a pepper spray! i'm not kidding! you could keep an a.hole away from you!Plus they won't get you into so much legal trouble! if I was you I would talk to the police. Then if its legal for you to carry a gun i would! along with the pepper spray! Pepper spray is a good first protection to choose!Good luck! do whatever you have to do to STAY SAFE!!!!
If you have not done so, you should your local police and make a death threat report.
This is your insurance policy, in case you are attacked.
Making a legal report does not give you authority to carry the knife, but it will be helpful if you are caught with it.
Step One: go to police station and file a report.
Step Two: go to court and get a restraining order, this can usually be done in one morning.
Step Three: sharpen the knife.
If you don't do all three of these things you are a fool.

You're reading Hey, there is someone after me who supposedly wants me dead. After hearing this i have armed myself with a knife just in case it comes down to it. My question is, if this guy attacks me, and by a chance he is seriously injured, is this self defense?
