Help answer this question below.

I've been living with my boyfriend for 7 months. I do not work and have 2 kids. I am not on any kind of assistance and the father pays child support, but is not entitled to claim them on his taxes. Can my boyfriend claim us on his taxes?

    Definitely. Each person can be claimed as a dependent on exactly one tax return, so if the ex doesn't claim them (or you), you're good to go.

    No. you have to be legally married or at least a common-law man and wife for seven years, to qualify.

    Provided noone else is claiming them on their taxes, he can claim them as dependants as long as he is providing at least 50% of their upkeep. The major complication in this situation, is if you are receiving any type of public assistance or support from the father(s) of your children.
