Although I suspect your question is a joke, I am going to give the legal answer anyway. This refers to California law. It most likely IS NOT. The statute states, in relevant part, that the "telephone [be] specifically designed and configured to allow hands-free listening and talking, and is used in that manner while driving" Therefore, if the phone was equipped with bluetooth or a headphone jack, then it would technically be "designed" for hands-free use. Furthermore, strapping it to the side of your head would make it "configured" for hands-free use. However, a court will likely read this to mean that the configuration must correspond with the design, and therefore, is a violation of the statute.

I may just do that. My phone is the Zach Morris, Saved By the Bell special edition version. It barely supports text messaging, let alone blue tooth. Actually it's just an old Nextel that will never die. If a nuclear haulocaust was to occur right now, two things would survive. Cockroaches and my cell phone. I dropped it down a flight of cement steps once and it gained a bar of reception. It's a flip out brick of a phone but o man do I love it. =P

I wish I had a pic but once during a serious conversation with a friend I used bungee cord to attach my phone to my steering wheel. Look so silly but worked.
