Im in a cust battle over my child for while now. i was going to court i found a pic of the lady that has cust of my child with duct tape around her mouth and hands while the car taker is holding her. my attny gave pic to judge he dissmissed pic any ideas?

    The evidence was most likely not admitted because it is irrelevant. A threshold question for the admittance of any evidence is that the evidence must be relevant (i.e. make a fact of consequence to the case more or less likely) to the case at hand.

    Your case is about whether or not you should be granted custody, not whether or not the current caretaker should lose custody. Thus, the picture has no relevance to your case.

    The evidence was either irrelevant, unreliable, or unduly prejudicial; all of which would make it inadmissible.

    Yes, he was a good judge. He doesn't allow moral judgements about sexuality to influence him when it comes to the custody of a child.
