  • You have two problems. First - a conviction for 14601.2 (driving on a suspended license when the underlying reason for the suspension was a DUI) carries a punishment of "not less than 10 days or more than six months" plus a fine. It has a mandatory minimum jail sentence. [See California Vehicle Code section 14601.2(d)(1)] Your second problem - you're probably on probation for your underlying DUI. Some of the terms of your probation is to "violate no law" and to not operate a motor vehicle without a valid license. You just violated your probation two ways. As such, you could receive additional jail time for the probation violation as well as your 14601.2 conviction.
  • Previous answer above...CRAP... Just to scare you..its only reading the VC book but what happens in court is a whole different story..like i answered on the other board for this question... I received this same charge in CA...according to the VC Book the above is true by the book laws I looked it all up too before I went to court but what happens in court is a lot of wheeling and dealing...as long as you get your license reinstated the Public Defender or your attorney...(i suggest not wasting your money on an attorney unless you have some other serious charges)...can drop it down to Driving without a license...which plead guilty get a possible 10days jail time (suggested) (but jails so full they don't want to waste space for 10 dayers)...2 points on DMV record and 1200$ in fines or plead not guilty..no points on driving record 430$ fines and no jail time. Just wanted to give people in same situation a real life account experience not read by the book accounts of this charge. Unless you have really horrible luck and a bad rap sheet you should be ok...otherwise jailtime is possible...judges don't like multiple offenders who don't learn they're lessons..but they do have heartbeats and some are willing to give second chances. This is just my first hand experience...my suggestion save yourself the stress and don't get in this situation.
