Help answer this question below.

My friend needs legal help. she violated drug probation and left the states because she wasnt a citizen. can she ever come back to the states without getting time?will they arrest her at the airport?shes really scared... who know for sure?

    First - a plea of guilty to a felony most likely did/wil result in deportation, denial of naturalization, entry or amnesty in the U.S. If she violated the term of her probation, it's most likely there is a warrant out for her arrest. I don't think (but I'm not 100% positive) that customs and immigration were NOT currently screening for warrants upon entry to the US. I would absolutely NOT base any action on my answer, though. I'd strongly suggest you contact her attorney or an immigration attorney for concrete advice.

    One thing I can tell you, though - if the warrant does come up, she'll be taken into custody and face the violation. If she was excluded from the US, she could possibly face Federal prosecution for unlawful entry in to the US.

    My friend who was not from is not a citizen just got deported for drug charges. She had lived here her entire life. She can not come back for ten years. If your friend wants to be able to come back one day tell her to come and face the charges. It's a good chance she won't have to serve time, but instead just be deported and not be allowed to reenter for 10 yrs. She will be put in immigration jail while she is here, which is 100x's worse then normal jail. If she could care less about not coming back then tell her to forget about it. She should always contact a lawyer and immigration before coming back.

    She can be arrested at any time, including but not limited to overseas arrest pending extradition. Leaving the states is not a deterrent for an arrest. Leaving the states to avoid jail time because a probation violation will make her seem like a career criminal who refuses to conform to court mandates. If she even wants a chance at a new life in the US, then she will have to come back, go to court, turn herself in and start the process all over again. It could go either way. She could do jail time, or get a lenient judge who would offer a plea, and a new probation deal.
