Help answer this question below.
What do you do when your business partner changes the locks on the business and you didnt know about it until you went to open and fould the locks changed.
This partner had a new business license with other partners and put a new business in the building doing the same thing. This partner when contact to see what was going on said she had disolved the partnership the night before. she even told the poice that. the only thing the police said was fight it out in court. So they were alowed to keep all inventories etc. They have also sense been phone herasing us.
This partner took all inventory etc. This partner was the only one named on the lease of the building however clearly the paperwork shows it was intended for the business she turned on. NO contact was ever signed however under the partnership act of TN this clearly brokes the act that states the partnership can start other partnerships however as long as it does not hurt the other one. This is found under duty of lolity.
WHO CAN we get to help seek charges? THe attoney general or the FBI ? From what came to light, this was a plan that this business partner planed months ago with her new parnters ,to use other peoples money and then take the business.
HELP- Would this be considered.
There is alot to this story, FACT that clearly show this was a scam..
That depends on the structure of your business. If you are a partnership, generally you would just sue him. It is a crime to embezzle in a partnership, but it is nearly impossible to prove beyond a reasonable doubt because the partner has the right to the assets. Corporate embezzlement is easier to prove (and the secretary of state can help you prosecute) because the law imposes duties on corporate actors (which duties are generally set by contract in a partnership).
However, in either case you can call the police.
