  • Yes. If you doing anything that is threatening to a policeman then he can arrest you for attempted whatever-he-cares-to-make-up. It's called abuse of power, but you would never win in a court of law. All he needs to say is that you made a movement as if to draw a gun and he reacted. People have been shot playing silly beggars like that.
  • The simple answer is yes for all of the above reasons. The best solution to not get arrested is to aim an invisible (non-existent) gun at an invisible (non-existent) officer. The only risks then are an invisible (non-existent) arrest.
  • In addition to the risk of arrest, you could also get yourself shot or killed for pretending to point a gun at a cop. I wouldn't call this abuse of police power -- cops live's are in danger every day. If a police officer think's his or her life is in danger, they are entitled to protect themself with whatever force they think is necessary. There are plenty of situations where someone might not notice there's nothing in your hand -- for e.g. in high glare, or low light conditions.

  • I have never been in this situation. i would have to make a split second decision, based on the circumstances. criminal law is based mainly on intent. I would only hope that i had the correct wisdom to make a decision that is justifiable as well as within the scope of the law.
