Help answer this question below.

I keep getting annoying prank calls from the same person. He says he is recording them and putting them on youtube. I tell him to stop but he doesn't. I know who it is and I'm really getting ticked off. Can I get the police involved in this?

    If you want to you can call the phone company and they will deal with the police to stop the calls.

    You can certainly call the police, but this may or may not be a crime depending on what state you live in. However, it is actionable under tort law in every state.

    There are two possible crimes here. First, the recording of the call is a crime in some states. Second, this might be criminal harassment in some states, but is not in others.

    It is important to note that this fact pattern evokes Freedom of Speech considerations. Thus, states that have criminal harassment statutes that include phone communications have strict requirements of "malice" or "specific intent to do harm" or something similar. Thus, if it is legal to record the conversation with only one party's consent and it is being done with the intent of creating online content, it may not be harassment in your statement.

    However, my advice is this: call the police non emergency line and tell them what is going on. They will tell you if they think it is criminal in your jurisdiction, and what to do about it.

    Yes, this is harassment... but you need to go through the phone company first. They'll look up the records of his calls to you, and initiate appropriate action.

    just dont answer the phone for them anymore silly..lol and if you do answer the second you hear that it is them hang up and dont even bother. because you getting all mad is exactly what they want from you.
