I was in a car accident and not responsable but the person i was with is and the car insurance want pay for the medical bills and neither will my health ins.want sew the person driving b/c he is my bestfriend what should i do

The at fault party's insurance has to pay. They don't have a choice. If they were at fault there is no way to get out of paying. Get a lawyer, or call the insurance commissioner.

Have him give you the name and address of his insurance carrier, and then have the bills sent to them. There is no need to sue anyone. It should all be automatic.
