Yes because if you had it on a leash then YOU have it under control and therefore YOU are liable.
Why allow your dog this torture? lol, Why dont you just "accidentally" let his dog chase your car since the dog is off the leash and "accidentally" hit the dog with the car. All is well and you shouldn't be liable, i think, i've never tried it, i like my truck too much :p

I don't see how your doing the right thing the other dog is on the loose your dog is protecting his/her owner or the home.

Where I live, if you are walking your dog on lead and and an unleashed comes loping up to yours, if your dog bites the unleashed dog, the owner of the unleashed dog is liable.
Unfortunately, no. The law still expects you to be able to control your animal. And, yes, your neighbor is an ass. Have faith: what goes around does come around.
