I don't believe its legal to stipulate where you can and cannot take your breaks, if you want to go halfway around the world you should be able to as long as your back in 30 minutes (I know it doesn't take 30min to go around the world, its a figure of speech).

If you are to be paid for your time out, and the "clocking out" is only for verifying that you took break.. then YES they can stipulate that you must remain on the property,(building). This is for their insurance purposes. If you are injured while on "company time" then you are specific to your work location. Example: If you drove to the nearest burger joint and had a car wreck, the company would be responsible because you were being paid for that time, and you could claim Workmans compensation for that car accident. This is why you are to remain in the workplace, so that any accidents are specific to your work area. However, since they require you to clock out, and if you do not have a paid time off, then you are free to go anywhere you want to go as long as you return on time to clock back in.
