  • Only if you can prove it! It's usually their word over yours.. and without proof, accept the fact and move on.
  • If you committed the crime, pay the fine. They wrote me a ticket saying I was driving a 4 door, but technically was a 5 door. I tried that, and it didn't work. Costed like 60 bucks or so.
  • No. The officer can correct any information on the citation, in traffic court.
  • Writing in the wrong location is basically your only chance and slim at that. It depends on the magistrate or Judge whether he wishes to dismiss it. You are better off looking for a fault in the roadway or signage.
  • Depends on what is wrong. If there is something wrong you can argue that there are other things wrong. My mom got her ticket dropped because the wrong date was on it. The ticket has to be correct.
  • Can you guys explain what do you mean by wrong date.Like if an officer writes 16 instead of 17 how can you prove in the court it is wrong. thanks
  • No. any incorrect information, on a traffic citation, can be corrected by the officer, in open court. This does not alter the fact that the violation occured.
  • they told me that the officer would just correct the info on My Tx. no seatbelt ticket, DOB wrong by 6 months, three digit zip code, and calling a concrete divided median roadway a non-divided street, at which point I took two steps backward, shoved the citation into My back pocket, and said," not on this copy he aint, and its the one im here to deal with. Unfortunately, thats why Im here today, as they basicly told Me that coming armed with the truth instead of a lawyer was a mistake. I walked out with My finger in the air and havent been back. yea , dumb move you say? protecting whats right is NEVER a dumb move. Ive never, nor will I ever pay a no seatbelt fine with anything other that time served. and just like the Tx helmet law, if enough folks refuse to pay for red light cameras and more tasers and tires for cruisers that are driven like if by drunken teenagers, and instead say hey, you know, i dont know how much it costs to feed and house me here, but I appreciate the offer and im gonna take you up on that, then the unfair law goes away, like the helmet law did. this also kinda stands up for the poor who cant afford to pay more for everything they buy, as they do, and finance the local departments fun army games. Ill admit that I wasnt wearing a belt, not that I believe its ANY of ANYONES business, but when a cop , who does this very thing every day for his bread and butter, and still cant get any closer to accurate than that, makes such mistakes on a document that leaglly forces a person to give up money for his family, then that document should be void of is athourity. I mean really if a national bank exec. or the ceo of a large automaker, or an insurance giants ceo and co. leaders screwed up like that, would you say , awww hes just a dumb ol ceo with too much on his mind to worry about trivial stuff like getting it right!!! well I do My job corectly every day and furthermore if I didnt, Id correct the problem or be fired. Also if I were to allow an in court correction by the officer, and he hadnt met citation quota for the month whats to keep boss hog and the rest of the hazzard co. sherrifs dept from learning from our current presidential admin. and disreguard proceedure, and stick Me with whatever else they want cause I like to cause a fuss when respect for whats right is ignored. Whew!!! dont get me started on the government. That felt good anyway, and nice and slow just like I like it.:-p
  • I have a theory that the reason most of us think it to be wrong to let a careless officer change info on a ticket in court, may have had it roots here. Amendment IV The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no warrants shall issue, but upon probable cause, supported by oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized. I would think that ,"particularly describing the place to be searched, and the persons or things to be seized." should also pertain to an accurate description of the person you accuse of any crime however non-felonious and minor it may be.
  • Well i got a citation.. On it, it says Above Subject was passing cars at a high rate of speed while approaching an officer. The officer had to slow down to avoid being struck. My problem is that it was just 1 car..CARS means more than 1 car.. And he never stated what speed i was going nor the speed i should've been going.. His department isnt on the citation and he didnt give me any numbers to call for information. I was told it was suppose to be there.. But i dont know if i should bring these facts up in court or not?
  • A local judge once made the following comment: "There is a single answer to every legal question...'It depends'". Sounds flip and ignorant, until it sinks in.
  • Depends but you may have to really look up whatever code or violation that they written up because police now these days hardly ever read the rule book.
  • My friend did once. He showed me the ticket and it looked like an infant wrote it. The judge couldn't even read it. From what I could read it said that he got a ticket for being a good driver. NO JOKE
