    lee harvey oswald never fired a shot.......i live near dallas and the assassination site......he was a patsy...it was all about the cuban's and the fact that the vice president LBJ wanted to go to war......take care...Brian.....

    Hard to say. Hinkley didn't get executed, but of course, President Reagan didn't die as a result of the shooting. My guess, though, would have been he would not have gotten the death penalty if it had gone to trial.

    Probably not because he would have gotten a lawyer (maybe probono) who would have shown he was innocent and might even have been able to show who did it when the trail of dead bodies led right to Salt Lake City.

    I would say no - the Kennedy's have never been much for the Death Penalty, and besides, if Oswald is in jail they might learn the details of his crime that might never have been gotten in a trial.

    It would have been difficult to successfully frame him, as there was no real evidence against him. His status as a CIA agent & former one in the ONI would surely have come out. The often quoted "evidence" would have been inadmissable due to a lack of "chain of possession."
    And what could he have told us! According to Captain Fritz he could not find a tape recorder or obtain a stenographer to record his interogation. Who believes this?

    As unfortunate as it is, the answer is most likely no. During this time (Nov. 22 1963) the death penalty in Texas was not around. However, in this present day, the death penalty is among Texas law. Oswald would have more-than-likely been given a life sentence with no possibility of parole had the case gone to trial (had Jack Ruby not coincidentally killed him).
