This happened to many German/Americans in World War II. They tried to send most of them to the Pacific but a few were sent to Europe to fight their ex countrymen.

In your hypothetical what is the citizenship of the mercenary? This very thing has happened with members of the French Foreign legion – but the outcome depends on the citizenship of the Legionnaire.
