  • Yes they can.
  • Yep they can legally do so. Read the contracts and you will see that the HOA can pretty much govern anything when it comes to your home and yard. In some cases they can even govern what type of vehicles you may or may not have parked in your drive..I personally would never buy a home in a place that was ran by the HOA :)
  • This is what you agreed to when you signed the papers they told you to. HOA is a terrible organization, watch out for buying their properties!
  • Most definitely! I always find it interesting he people who say "HOA's are evil and I would never buy a home that had an HOA." Most people who end up buying such homes were attracted by the well kept appearance of the neighborhood, yet get upset when the rules that apply to their neighbors apply to you as well. On the other hand, many people who do not have an HOA get stuck next to the homeowner who paints their house lime green, does not upkeep their yard, and has broken down vehicles parked in their front yard. The moral of this story is that there is a trade off no matter which route you take. If you don't see the value in an HOA, that is fine, but that does not mean that they do not have value. Even though you may be restricted as what you can do to your property, HOA properties tend to have higher resale values than non-HOA properties.
  • These days, it is hard to find a neighborhood that do not have HOAs (and those that originally did not have one now have HOAs). If this country was founded on freedom, then why would someone give their rights (as well as their money) away? If my neighborhood all of a sudden got an HOA, then war will be declared. I will get the purple and lime green paint, I will get the Dodge Ram 2500, I will get a fence, a satellite dish (the big 10' one), and I will plant Venus Fly Traps and Pitcher Plants in my front yard.
