  • Hi. I think I can help you out somewhat. I'm a criminal justice major and I know a little bit about this, I think. I don't know about Pennsylvania, but in most states, you are considered a minor until your 18th birthday. Therefore, your parents are responsible for you until then. If your parents are hitting you, to a point to where you are very badly bruised or injured, it is considered child abuse since you are a minor. If this is the case, I would immediately go to another family member's house until something can be done. Whatever you do, regardless of the situation, DO NOT runaway because you can now be charged for running away from home. But, your parents' are responsible for you until 18, unless a court has granted you as a "legal adult" but still underage, this happens but rarely. I would contact someone about getting help in dealing with situation.
  • If your parents decide you can go, then you can go. However, keep in mind, that as a minor you will be unable to contract for anything other than necessities (ie: No car loan for you). So for every major purchase, you'll need to go back to your parents to co-sign any papers. Until you reach the age of majority you are a child in the eyes of the law (with numerous exceptions) and you are essentially unable to make your own decisions. The only way to become independent as a minor is to become emancipated. In Pennsylvania, becoming emancipated is a factual determination using various factors of dependency. So essentially, if you move out, get a job, support yourself and so forth you will probably be able to achieve emancipation. If you get a court order saying you are emancipated then you will thereafter be treated as an adult. The reality is, if you want to move out and your parents don't care, then go ahead. No one is going to interfere.
  • My niece 17 going to 18 january 17, 2009 was kicked out of house by her father in june 2008 and he went and give custody of her to a woman that has no relation to her. She goes to school and works 40 hours a week. The woman kicked her out of that house on thursday november 27, 2008 and she took her things and now the woman told her that if she did not come back she was calling the cops and getting her in trouble. Would she be emancipated based on the facts in the question.
