In California, if a neighbor's tree root is causing my driveway to raise 3 inches and she allows the root to be cut when I remove and replace driveway, is the neighbor responsible for repair if her tree damages my driveway in the future?

    You do not need her permission to cut the root and you may be entitled to damages.

    Anything on your side of the fence is your problem. No she is not responsible for your driveway first or next time. She is responsible if it damages the fence between you.

    yes you should go talk to her, if it gets costly bring it to the police, that kind of things not fair, but dont go to hte cops unless you absolutely have to
