The Medal of Honor is is awarded by an act of Congress after a lengthy and thorough investigation by a military personnel into to the particulars of the incident. If it is determined that the nominee is worthy, then a recommendation is passed up to the Congress which must authorize the award. The fact that an act of Congress is required for someone to receive the Medal of Honor has led many to incorrectly call it the Congressional Medal of Honor. However, this was something that was emphasized to me by my JROTC instructors. It is just the Medal of Honor, not the Congressional Medal of Honor.

The Medal of Honor is the highest award for valor in action against an enemy force which can be bestowed upon an individual serving in the Armed Services of the United States. Generally presented to its recipient by the President of the United States of America in the name of Congress, it is often called the Congressional Medal of Honor.
