  • I don't think you can. You need to be fired in order to receive unemployment. But, make sure to stipulate your loss in your lawsuit in order to receive adequate compensation Perhaps this answer is different from state to state. I'm in California, so the laws may be different here. The only people I have ever know to receive unemployment have been fired or laid off (which is also a way of being fired I suppose).
  • Generally, no. Why wouldn't you simply seek other employment? To qualify for unemployment you generally need to be unemployed through no fault of your own and actively seeking work.
