  • If it is a townhouse this wall should be a limited common element. Most associations assume the task of repairing limited common elements, however this is not always the case. It all comes down to your governing documents and this area of responsibility should be specified in them. Get real familiar with them. If the Board has made repairs to other common party walls this could have set a precedent for their policy. I do not know all the facts so I can only touch the surface on this one. You might want to consult an attorney if the research you have done points to the association being responsible for limited common elements. What caused the seperation. Do they have grounds not to make the repairs? These questions should be answered once you have reviewed the governing documents and Board policies.
