  • It's your job to know the rules, you agreed to them when you bought the condo so yes, they can and you are obligated to pay.
  • Check your bylaws. But our State HOA Guidelines Manual states that you are always to be given the opportunity for a hearing to be heard on the issue before a fine can be issued. Request a hearing and ask your questions, and for proof of the bylaw and proof that notification of the change was sent to all members. It can't hurt.
  • Also ask for your HOA's Rules of Bylaw Enforcement Procedures, which will tell you if you are entitled to a warning before you receive a fine.
