You're reading Can a police officer walk into a bar and tell everyone if anybody gets in their car and attempts to drive he will pull them over? And then stop them before they get out of the lot, and arrest them for DUI?

everyone who answered this way is absolutly correct that one shouldn't drink and drive, however the police are supposed to follow the law and the 4th amendment of the U.S. constitution says that a car cannot be pulled over with out reasonable suspicion. this person was not in any contact with officer, officer did not view any behavior and there was no traffic violation. he assumed because someone was in a bar that he or she is intoxicated. if the police start doing that then they will have no time for anything else.

The 4th amendment doesn't say anything about cops pulling over cars, and because driving is a privilege granted to you by the state, you can be pulled over at anytime for any suspicion that the officer may have. They are allowed to question you if you appear suspicious. Coming out of a bar by yourself and heading to your vehicle is definitely probable cause for stopping and questioning someone. What are the odds that you are going to choose only the people who go in bars but don't drink? It's better to take 30 seconds of every patrons time, rather than let one patron go, who ends up swerving into the other lane, and killing an innocent family. Wouldn't you agree?

The officer went into the bar and gave a warning to everyone which is legal. If somone got into his car and started to drive off the lot, the officer was within his rights to stop and arrest the subject for suspicion of being intoxicated. He warned all patrons to not drive are they would be arrested. They simply broke the law. I am from a cop family and worked for a police department for 13 years.
