Help answer this question below.

My son was born last may. His mother and I aren't married and live apart. She has custody but I pay Child support. Can I claim him as a dependent?

    Mom is the custodial parent per IRS definition and has the right to claim the child as of 2008. Unless she releases the exemption on Form 8332 to you, she gets to claim the child. Sorry!

    Only one of you can claim him as a dependent. This means you'll have to come to an agreement between yourselves. The IRS doesn't say who can take it, only that both of you cannot.

    No, but current child support guidelines take that into account, so if you were to get it, you could also pay more.
