  • I assume you're talking about people accused of a crime getting the proceeds of insurance, etc? I think that most policies have a criminal acts clause to prevent persons convicted of a crime from benefitting from that crime. If there isn't a clause, the court may award any settlement as they see fit.
  • Since parents could not possibly recover any money from a wrongful death claim unless they have brought the action, I'll assume that's the case. The answer, then, is yes, the parents may recover at least a portion of any settlement or judgment. The Texas Civil Practice and Remedies Code specifies that the surviving spouse, children, and parents of the deceased are all entitled to bring and benefit from an action for wrongful death, and that any damages awarded shall be divided among these individuals, although the division of the money does not have to be equal [Sections 71.004(a) and 71.010(b)]. http://www.statutes.legis.state.tx.us/
