  • 1. In a truck stop the truck is on private property. 2. In a wayside rest stop the truck probably is on public property unless the area is privately owned. I woud assume it is always ok in # 1. And, who is going to see you in either instance if you are in the sleeper area?

  • I wouldn't know, but the 10 hour rest period isn't long enough for the alcohol to leave your blood stream. In the UK you're not supposed to drive again untill 12 hours after your LAST drink. You may still be over the limit!
  • You are not permitted to carry any alcoholic beverage ANYWHERE in a commercial motor vehicle, except in the cargo area IF it is bonafide cargo as listed on the Bill of Lading. Therefore, unless you are having someone in a private vehicle delivering you the drinks, you wouldn't even have the legal opportunity to obtain a drink in such a place as a public rest area. In any case, you aren't going to want to have the keys anywhere on your person or in the truck if you do drink. In many states, you can be charged with DWI when on private property. You may be charged even if the vehicle is not running, as long as the keys are in the ignition, and in some cases simply if they are under your control. You DO NOT want to take that risk in a semi-truck. The required BAC for a DWI is much, much lower (I think .03) then with a regular license. For some people, half of an alcoholic beverage is all it takes to put them over the legal limit. If you hold a CDL, it is simply not safe to have any alcohol whatsoever, and get into any vehicle, regardless of whether you're planning to move it or not, EVER.
  • no way you have a CDL, because you should know that you are NOT allowed to have alcohol in the truck PERIOD! We are not even supposed to have a bottle of listerine, or a bottle of alcohol.. I keep at least 2 bottles of clear antiseptic alcohol in the truck in case i get a cut, or can't get to a shower, I can use it to bathe.. AHHHHHHH IT WORKS!! LOL
