  • By "Legal" standards,the authorities will say you. You would be cited with "Failure to maintain control of vehicle".Regardless of their stupidity,you get the fall.Try not to make it fatal,unless you plan on taking a vehicular manslaughter.Those people need some type of pedi-airbags?   • The driver is always considered to be responsible to maintain control of the vehicle.

  • I would think it would be their fault. Unless if they were crossing at a crosswalk then they might have some rights, because you can't argue "jaywalking"
  • If they can hit you at more than walking speed, then surely you must have been travelling too fast to react within your field of view. (Having said that, how far could you get driving at the safest speed in an urban area.)
