  • I believe that the uninsured motorist check comes from the "uninsured motorist general pot" Your insurance company pays your UM payments to this "general pot" which is a pool much like the lottery funds, it has nothing to do with your insurance company other than it accepts your payments into it. It paid you for your damages, and now your insurance company owes you the $500 deductable from their company. You can cash the check without fear of finalizing your claim.
  • In most states, insurance cos assume everyone is insured until proven otherwise. If and when you can show proof that the other party was uninsured, the insurance co considers them insured and therefore you are subject to the ded under your collision coverage. Check your policy for definition of (un)insured driver. Sorry.
