  • Rear-ending a stopped vehicle is definetely reckless driving and following too close. question: just before the crash, what was the driver doing, inside his vehicle, before the crash? cellphone useage? drinking? there is always a reason a crash occurs. How is your driving record? this will be a chargeable offense on your record. If this was your first offense, you may get to go to defensive driving class. the cost varies in each state. The citation is not your biggest concern, its the victim you rear-ended. most likely, you can expect a civil lawsuit, from this crash. the reckless driving citation, will play a major part in monetary damages to be awarded to the other victim.
  • Actually it was my wife who was rear-ended and she was doing nothing except sitting at a red light. The other driver at .4 miles of a slight downhill grade and clear view of her and the other 6 cars stopped at the light. Thankfully she always keeps at least 1 car length when stopped at a light so she didn't hit the car in front of her. My question was more about the other driver. For the life of me I cannot see how he could have hit her. With .4 miles + almost 20 seconds (timed) to react but yet hit her at 35mph.

We also had an officer, stopped on the interstate to help a lady with a flat tire. this was a 2-mile stretch of straight, level interstate. blue lights on, not much traffic. a lonely tractor-trailer rear-ended the police vehicle and killed the officer. driver was arrested. This happens, not just to civilians, but the police as well.
