Can the police curse at you even if you didn't say anything to them?

    I have a friend who flipped off a police officer who now has a court date because of that. So...I would say the police can haul you in for that.

    You technically have a first amendment right to curse at a police officer (assuming you are just cursing and not interfering with the officer's job or creating a breach of the peace). However, most cops don't care much about your first amendment rights and may arrest you or ticket you regardless of those rights. The judges that handle these kinds of minor cases are not necessarily rocket scientists (or constitutional law scholars), so they'll probably find you guilty. Unless you don't mind spending a few hours in jail and can afford a decent lawyer, I wouldn't recommend it.

    Yes. It is also legal for them to smack you with a nightstick because of it. Freedom of speech is kind of a common-sense sort of thing.

    Well according to our civil rights, yes. But apparently there's some fine print no one knows about that you have to exercise your rights in an orderly, respectful fashion. Police are power hungry and abuse their power any chance they get. So you'll get shit for swearing at them.

    The police should never curse at you. You cannot sue them, but it is very bad manners as we are to look up to them as examples and they probably should be reported.

    last night my boyfriend and i got off of a long day of work at a concert and we were looking for our ride.

    my boyfriend was on the phone with our ride and he walked in the street to wave them down.

    a cop drives up to him and screams "GET THE FUCK OUT OF THE STREET"

    my boyfriend said "ok, relax" and walked on the sidewalk.

    next thing you know there are 2 cop cars and they are in his face screaming at him.

    "WHAT THE FUCK DID YOU SAY TO ME?" "WHAT THE FUCK ARE YOU THINKING?"

    so our ride, my bfriends parents pull up, get out and ask him why are they surrounding him and screaming at him.

    the officer said "YOUR SON TOLD ME TO RELAX, THATS DISRESPECTFUL TO SPEAK TO ME LIKE THAT."

    at that point i said "dont you think its disrespectful to curse at him?"

    he said "GET BACK IN THE CAR ALL OF YOU I WANT YOUR ID'S."

    (mean while there are about 50 drunken concert-goers in the street. some mocking the cops.)

    end of story we got two tickets.

    one for improper behavior and another for obstruction.


    WHAT CAN I DO????????

    An officer may curse in general as everyone else does, however the officer may be governed by his standard operation procedures not use profane language at the public in the course of their duty. If an officer offends you, you do have the option to report the incident to a police supervisor and it will handled through internal afairs.

  • The verb 'curse' covers a lot of ground from mildly coarse language to full blown blasphemy. You would have to be a wee bit more specific about what kind of cursing you are referring to.

    Hmm well it's a very controversal matter hunny! It's not right by any means BUT as that person has a higher authority over you, they may well get away with it :(, It really depends on who deals with the police officer who cursed. It's wrong and that officer shouldn't get away with it, but nowdays the world is so controversal that the officer may well do.
