BUSTED NEW ROCHELLE - A library board member and former school board candidate who has worked extensively with youth was arraigned yesterday in Connecticut on felony charges that he used a computer to arrange for a sexual encounter with a person he thought was a 14-year-old girl, police said. The "girl" turned out to be a detective with the Naugatuck, Conn., police. Frank Pasquale III, 43, of 50 White Oak St. is charged with attempted second-degree assault, attempted risk of injury to a minor and use of a computer to entice a minor, felonies, police said. He was arrested Thursday in Naugatuck, a town of about 35,000, where he went to meet with the person he thought was the underage girl, police said. Lt. Robert Harrison of Naugatuck police said that on Jan. 18, Pasquale began conversing in a computer chat room with the detective, who had set up a profile as a 14-year-old girl. The conversations turned sexual over the course of a few days until Pasquale arranged to meet her in Naugatuck, Harrison said. He was arrested, held overnight on $500,000 bond and arraigned yesterday in Waterbury in Connecticut Superior Court. He was released after posting a $20,000 bond and is due back Friday. Attempts to reach Pasquale yesterday were unsuccessful. A phone number listed for him is no longer in service. In announcing his school board candidacy last year, Pasquale wrote on his Web site that "I care a great deal about the youth of our city," that he has volunteered with young people for 23 years and that he is married with two children. He said he worked as a fair-housing testing coordinator for Westchester Residential Opportunities in White Plains. Pasquale has been a library board member for several years and worked with youth at a Rye church. He has coached youth league baseball and was a volunteer with the New Rochelle Youth Bureau. He ran unsuccessfully for school board this past spring and was heavily involved in Republican politics in the city. "I'm shocked and disappointed," City Republican Chairman Doug Colety said when told yesterday about the allegations against Pasquale. He declined to say more until he learns more about the charges. A woman who answered the phone at the Church of the Resurrection in Rye, where Pasquale had worked in a youth ministry, said he stopped doing such work there about a year ago. She declined to give her name. Pasquale also has a radio program on WVOX at 11 a.m. each Friday. The show did not air yesterday.

NEW CITY - Beth Modica pleaded not guilty this morning to charges that she had sexual intercourse or oral sex with two teenaged boys, served them alcohol and smoked marijuana with them. County Court Judge Catherine Bartlett set Modica's bail at $75,000 cash or bond, an amount greater than the $25,000 cash or $50,000 bond requested by the Rockland County District Attorney's Office. Modica's attorney, Gerard Damiani, objected to the figure. "Your honor," he said, "The DA recommended bail at $25,000." Bartlett responded sharply. "I heard it. These are serious charges involving children in her community," she said. Damiani had requested that Modica, the estranged wife of Spring Valley police Chief Paul Modica, be released without bail on the 35-count indictment. She was charged with five felonies: one count of third-degree rape, which is statuatory rape; and four counts of third-degree criminal sexual act, involving accusations of oral sex. She also faces 30 misdemeanor charges: four counts of third-degree sexual abuse and 26 counts of endangering the welfare of a child. The incidents in question happened between July 1 and Sept. 2, District Attorney Thomas Zugibe said during a press conference after the bail hearing. Between July 20 and 22, Beth Modica is accused of having had intercourse and oral sex with a 16-year-old in her home, as well as oral sex with a 15-year-old. She is alleged to have served alcohol to both of them. On other dates during the two-month period, Modica is accused of having had oral sex with the two boys at her home and once in the 16-year-old's home. She also is accused of drinking alcohol or smoking marijuana with them in her car on various occasions. Zugibe and Ramapo police dispelled one rumor that had run through the community before the indictment was unsealed today. "My understanding is there is no involvement of the hockey team, whatsoever," he said. In addition, he said, the investigation showed Chief Modica had no knowledge of the incidents. In requesting no bail, Damiani cited Modica's ties to the community - she grew up in Rockland, graduated Spring Valley High School, then Syracuse University and St. John's Law School before returning to Rockland, where she worked as an attorney in the District Attorney's Office in the late 1980s and early '90s and later became assistant town attorney in Ramapo and village attorney for Sloatsburg, where she lived with her husband and children. Damiani said Modica's character and morality had never been questioned before the current charges were filed. Bartlett was unmoved. Senior Assistant District Attorney Dominick Crispino is serving as prosecutor. Dressed in a gray suit, Beth Modica stood silently next to Damiani. Her mother, Judith Gardner, and brother sat in the courtroom. Gardner is the former assistant to the late state Sen. Eugene Levy and, later, Joe Holland, who succeeded Levy upon his death. Showing little emotion, the former prosecutor, Beth Modica, 44, of Sloatsburg, pleaded guilty to statutory rape for having had intercourse with a 16-year-old boy and to a criminal sex act for having had oral sex with a 15-year-old boy. She surrendered immediately. ”She’s a sexual predator, let’s make no mistake about it,” said Thomas Zugibe, the Rockland County district attorney. “You can’t differentiate between a male and a female victim.” Ms. Modica’s estranged husband, Paul Modica, the Spring Valley police chief, was in the courtroom as the defendant told Judge Catherine Bartlett of Rockland County Court that the sex acts occurred in her home. The Modicas have four children. The judge promised Ms. Modica, who had served as an assistant district attorney in Rockland County and Queens, a sentence of two years in prison followed by 10 years of supervision. Mr. Zugibe said the sentence was fair, noting that the plea meant the young victims would not have to testify at a trial. Formal sentencing was set for June 13.
